1. INTRODUCTION

All access to and use of this website and associated online systems (“Website” and “Online Systems”) are subject to these Terms and Conditions (“Terms”). By viewing, accessing, or using any part of the Website or Online Systems, you acknowledge that you have read, understood, and agreed to be bound by these Terms, together with any other applicable terms, policies, and notices issued by BEYOND RADIOLOGY from time to time, including our Privacy Policy.
BEYOND RADIOLOGY may amend these Terms at any time by publishing the updated version on the Website. Continued use of the Website or Online Systems constitutes acceptance of any amended Terms.

These Terms apply to any engagement you have with BEYOND RADIOLOGY, whether paid or unpaid. These Terms are binding once you begin using BEYOND RADIOLOGY’s services or Online Systems. Additional, more specific terms may apply to certain services. Where there is any inconsistency between these Terms and such specific terms, the specific terms will prevail to the extent of the inconsistency.

6. ZERO TOLERANCE POLICY

BEYOND RADIOLOGY is committed to ensuring a safe, respectful environment for patients, clients, and staff. 
All employees of BEYOND RADIOLOGY have the right to carry out their duties without abuse, harassment, or violence. Any behavior—verbal, physical, or written—that causes staff to feel threatened, intimidated, or disrespected will not be tolerated. 
BEYOND RADIOLOGY reserves the right to remove or restrict access to its services, Website, or Online Systems for any individual who engages in such behavior.

7. USE OF WEBSITE AND ONLINE SYSTEMS

You agree to use the Website and Online Systems only for lawful purposes. You must not use them in any manner that could damage, disable, overburden, or impair BEYOND RADIOLOGY’s servers or networks, or interfere with any other person’s use.

  • Schedule appointments that you have no intention of keeping; or
  • Collect or store personal data about others in connection with prohibited activities.


BEYOND RADIOLOGY reserves the right to take any legal or technical measures necessary to enforce these Terms.

8. INFORMATION WARRANTY

You warrant that all information provided to BEYOND RADIOLOGY is true, complete, and accurate, and you agree to promptly update any information that changes.

9. PRIVACY AND DATA HANDLING

BEYOND RADIOLOGY handles all personal and health information in accordance with the Privacy Act 2020, the Health Information Privacy Code 2020, and BEYOND RADIOLOGY’s Privacy Policy.

By using the Online Systems, you authorise BEYOND RADIOLOGY to collect, use, and disclose personal and health-related information, including (but not limited to): 

  • Name, date of birth, gender, address, contact details; 
  • NHI number and health insurance details; 
  • Medical history, test results, and other relevant health information; 
  • ACC details where applicable. 

Your information may be used for the following purposes:

  • Administering and maintaining your medical records; 
  • Confirming, modifying, or managing appointment bookings; 
  • Contacting you regarding services or results; 
  • Quality assurance, analytics, and anonymised research purposes; 
  • Complying with legal or regulatory requirements; 
  • Debt collection or complaint resolution. 

BEYOND RADIOLOGY will not sell or share your personal information with third parties except as permitted by law or authorised by you.

10. SYSTEM ACCESS AND AVAILABILITY

BEYOND RADIOLOGY will use reasonable efforts to ensure the consistent availability of the Website and Online Systems but cannot guarantee that access will always be available, uninterrupted, secure, or error-free. 
The Online Systems are not designed for emergency or critical medical circumstances and must not be relied upon for such purposes. If urgent or emergency medical attention is required, please contact your healthcare provider or emergency services.

11. BOOKING APPOINTMENTS

All appointments are subject to availability. BEYOND RADIOLOGY may contact you to confirm, modify, or reschedule your appointment.

12. PAYMENT AND PRICING

Unless agreed otherwise in writing, any price quoted is an estimate of the anticipated cost of the services. The actual cost may vary. All prices are inclusive of GST and are payable in New Zealand dollars. 
Payment for services is due at the time of examination unless other terms have been agreed. If payment is not made by the due date, BEYOND RADIOLOGY may suspend services, charge recovery costs, and require payment in cash for future services until full payment is received.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by law, BEYOND RADIOLOGY excludes all warranties, conditions, and guarantees implied by statute, common law, or otherwise. 
BEYOND RADIOLOGY’s liability for any claim, whether in contract, tort (including negligence), or otherwise, is limited to the actual cost paid by you for the relevant services. 
BEYOND RADIOLOGY is not liable for any indirect, consequential, or special loss or damage arising from your use of the Website, Online Systems, or services.

14. INDEMNITY

You agree to indemnify and hold harmless BEYOND RADIOLOGY, its employees, contractors, and affiliates from any claims, losses, or liabilities arising out of:

  • Your use of the Website, Online Systems, or services; 
  • Any breach of these Terms; or 
  • Any infringement of intellectual property or other rights by you or anyone using your access credentials.

15. SOCIAL MEDIA AND ONLINE CONDUCT

BEYOND RADIOLOGY maintains a presence on various social media platforms. Engagement with these platforms is subject to their respective terms of use and BEYOND RADIOLOGY’s social media policy. 

BEYOND RADIOLOGY reserves the right to remove or moderate any comments or content that:

  • Contain offensive, abusive, or defamatory language; 
  • Disclose personal information without consent; 
  • Violate intellectual property rights; 
  • Promote commercial products or political views; or 
  • Otherwise breach these Terms or platform policies.

Staff acting on behalf of BEYOND RADIOLOGY will use official channels and identify themselves as such.

16. CHANGES TO SERVICES

BEYOND RADIOLOGY may from time to time add, amend, suspend, or discontinue any service. BEYOND RADIOLOGY is not liable to you or any third party for any modification or discontinuation of services.

17. DISPUTE RESOLUTION

If any dispute arises in connection with these Terms, both parties will endeavour to resolve the matter in good faith. If unresolved within 20 working days, either party may pursue any remedies available under New Zealand law.

18. LEGAL JURISDICTION

These Terms are governed by and shall be interpreted in accordance with the laws of New Zealand, and are subject to the exclusive jurisdiction of the New Zealand Courts.

19. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be severed, and the remaining Terms will continue in full force and effect.

20. ENTIRE AGREEMENT

These Terms, together with any supplemental terms, policies, or notices published on the Website, constitute the entire agreement between you and BEYOND RADIOLOGY and supersede all prior written or oral agreements relating to the subject matter.
